Terms of Service

These Terms govern your use of RecoverSolar ("the Service"), operated from Cape Town, South Africa. By subscribing, you agree to them.

1. The Service

RecoverSolar provides cold quote recovery, project pipeline, and client memory tools for South African solar installers to businesses on a monthly subscription basis. Access is granted via login at recoversolar.co.za/portal.html.

2. Subscription and Billing

Subscriptions are billed monthly in advance via PayFast. Prices are shown in South African Rand (ZAR) and include VAT where applicable. Billing recurs automatically on the anniversary of your first payment until you cancel.

3. Cancellation

You may cancel at any time from your portal or by emailing hello@recoversolar.co.za. No further charges will occur after cancellation. Your access continues until the end of the current billing period.

4. Refunds

All subscription fees are non-refundable. Partial-month refunds are not provided. Full refund terms are set out in our Refund Policy.

Service credit: If RecoverSolar becomes unavailable for more than 72 consecutive hours in a billing month due to our fault, a pro-rata credit is applied to your next invoice on request.

5. Acceptable Use

You agree not to use the Service to:

Send unsolicited bulk email or content that violates POPIA, CAN-SPAM, or GDPR
Impersonate another person or business
Attempt to reverse engineer, scrape, or interfere with the Service
Upload malicious code or illegal content

Violations may result in immediate suspension without refund.

6. Your Data

You retain ownership of data you upload (contacts, quotes, listings, client records). We process it only to provide the Service. Full data handling is set out in our Privacy Policy and POPIA Compliance page.

7. AI-Generated Content

The Service generates draft communications using AI. You are responsible for reviewing every generated output before sending it to a customer. We are not liable for content sent by you or on your behalf.

8. Availability

We target 99% monthly uptime but do not guarantee uninterrupted service. Scheduled maintenance is announced in advance where possible.

9. Limitation of Liability

To the maximum extent permitted by law, RecoverSolar's total liability in any month is limited to the fees you paid us in that month. We are not liable for indirect, consequential, or lost-profit damages.

10. Changes to These Terms

We may update these Terms. Material changes will be emailed to your account address at least 14 days before taking effect. Continued use after that date confirms acceptance.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of the courts of the Western Cape.
